The Texas attorney general has sued the FDA, the Food and Drug Administration and the Federal Trade Commission over a drug for which the FDA has denied a request for approval. The Food and Drug Administration has not received the request of the agency. The case has been referred to a federal judge.
The FDA and the FTC have denied the drug's request. At least 15 states and the District of Columbia have filed a similar suit to have the agency's approval overturned, the judge said.
